Amin v Amin EWCA Civ 1114, All ER (D) 197 (Jul) The Court of Appeal has recently upheld the decision of a lower judge to penalise a party who was in breach of a financial order. The party had previously been ordered to pay a lump sum but had refused to do so. As a consequence the court chose to enforce the breach by increasing the percentage of the pension share and ordering the sale of a property to meet accrued interest on the unpaid lump sum.
